The Kremlings aren't in Donkey Kong Country Returns due to developer choice, not legal reasons. Really, this is getting annoying now, people who don't know a bloody thing about ownership laws talking about how nothing from DK Country can return because of 'Rare's ownership' or people saying how 'nothing from the Mario RPGs is in the normal games' because of some phantom ownership over stuff Intelligent Systems/Alphadream are meant to have (even funnier considering Nintendo outright owns the former).
Indeed, let me state this nice and clearly... Nintendo owns everything in Donkey Kong Country, the Mario RPGs after the SNES one (okay, likely because of the SNES one debacle) and the opinion of a company who doesn't work for Nintendo any more is completely irrelevant to the question. Thank you.
God the freaking fanboy conspiracy theorists...

I have yet to meet someone who believes that, though. I mean, who think that Kremlings aren't in DKCR for copyright reasons, etc.

Honestly, did no one else play the PAON games? Those had Kremlings, and were obviously not DKCs. They were alright though.
EDIT: Better yet, why is everyone dissapointed with the lack of Kremlings? Don't get me wrong, I'm a big DKC fan, but I think it'll be good without them.
Some people argue that it's not a true DKC game, but why not? DKC Returns has;
-Barrel Cannons
-Mine Carts
-Vine Swinging
-Diddy Kong
-KONG Letters
-Bananas to collect
Honestly, I see so many people judge it negatively, and this is the only place I could post my mini-rant. This is a new Donkey Kong Country, not some Jungle Beating.

Koopalmier: You know, the company that made DK King of Swing and DK Jungle Climber. The games that brought back a lot of DKC enemies... And familiar Kongs... And featured Kremlings, and... I'm alone, huh.

To the people who say they know, it's mainly due to the Mario and Donkey Kong Country series fan dumb elsewhere. I personally of course hope the 'no crocodiles' bit is a lie to hide K Rool being the man behind the man in Returns though.

As big of a DKC nut as I am, I actually don't mind DK getting another new villain for this outing. If K.Rool turned out to be behind the whole thing, that would suck, because it would be a repeat performance of what happened in DKC3.
Now, if the Tikis hypnotized the Kremlings on the other hand...
